This Legal Policy governs access to and use of the Liberty Orthodontic Laboratory website, client portal, online forms, digital case-submission tools, and other online services operated or made available by Liberty Orthodontic Laboratory (“Liberty,” “we,” “us,” or “our”).
By accessing or using our website, portal, or online services, you agree to comply with this Legal Policy.
Laboratory orders, pricing, billing, warranties, remakes, shipping, and other commercial terms governing laboratory services are addressed separately in Liberty Orthodontic Laboratory's Terms & Conditions.
1. Authorized Use
Liberty's website and online services are intended primarily for licensed dental professionals, dental practices, authorized staff members, and other users with a legitimate business relationship with Liberty.
Users may access and use our website and portal only for lawful professional, business, informational, account-management, and case-related purposes.
Liberty does not provide orthodontic appliances or laboratory services directly to patients or the general public.
2. Client Portal and Account Access
Certain online services may require registration or an authorized user account.
Users are responsible for:
Providing accurate account information.
Maintaining the confidentiality of usernames, passwords, and other login credentials.
Restricting access to authorized personnel.
Promptly updating account information when personnel or authorization changes.
Promptly notifying Liberty of suspected unauthorized access or compromised credentials.
Each dental practice is responsible for determining which employees or representatives are authorized to access its Liberty account or submit information on its behalf.
Users may not access another client's account or information without authorization.
Liberty may suspend or restrict portal access when reasonably necessary to protect account security, patient information, Liberty's systems, or other users.
3. Electronic Case Submissions
Liberty may allow clients to transmit prescriptions, digital scans, case information, files, instructions, and related records electronically through approved portals or other authorized systems.
Users are responsible for confirming that information submitted electronically is accurate, complete, and associated with the correct patient and case.
Submission through an online system does not guarantee that a case has been accepted for fabrication. Liberty may review submitted information and request clarification, corrected records, or additional information when necessary.
Users should verify receipt of time-sensitive submissions when confirmation has not been received.
4. Patient Information and Protected Health Information
Patient-identifying information and protected health information should be submitted only through systems or communication methods specifically authorized by Liberty for case-related information.
Users must not submit patient records, scans, photographs, prescriptions, or other protected health information through general website contact forms or other channels not designated for secure case submission.
Dental practices are responsible for ensuring that their submission and disclosure of patient information to Liberty is permitted under applicable law.
Where applicable, the handling of protected health information may also be governed by a separate Business Associate Agreement between Liberty and the dental practice.
5. Acceptable Use
Users may not use Liberty's website, portal, or online services to:
Violate any applicable law or regulation.
Access or attempt to access systems, accounts, files, or information without authorization.
Misrepresent identity, authority, practice affiliation, or account ownership.
Submit fraudulent, misleading, malicious, or unauthorized information.
Introduce viruses, malware, harmful code, or other technology designed to disrupt or compromise systems.
Interfere with the availability, performance, or security of Liberty's website, portal, networks, or services.
Circumvent authentication, access controls, security measures, or usage restrictions.
Probe, scan, or test system vulnerabilities without written authorization.
Use automated tools to scrape, extract, reproduce, or collect substantial amounts of Site or portal content without authorization.
Use Liberty's systems in a manner that could expose patient, client, or confidential information to unauthorized persons.
Liberty may investigate suspected misuse and may restrict or terminate access where reasonably necessary to protect its systems, users, or legal interests.
6. Intellectual Property
Except where otherwise indicated, Liberty's website, portal interface, text, graphics, photographs, logos, designs, downloadable materials, page layouts, and other proprietary content are owned by or licensed to Liberty Orthodontic Laboratory.
Such materials are protected by applicable copyright, trademark, and other intellectual-property laws.
Users may access and use Liberty's content for legitimate purposes associated with Liberty's services.
Users may not reproduce, republish, distribute, sell, modify, license, or commercially exploit Liberty's proprietary content without prior written authorization, except where permitted by law.
7. Trademarks
Liberty Orthodontic Laboratory's names, logos, branding, service names, and other identifying marks may be protected trademarks or service marks.

9. Website and Portal Availability
Liberty makes reasonable efforts to maintain reliable access to its website and online services but does not guarantee uninterrupted or error-free availability.
Access may occasionally be unavailable because of:
Scheduled maintenance.
Software or system updates.
Internet or network interruptions.
Third-party platform outages.
Cybersecurity events.
Equipment failure.
Events outside Liberty's reasonable control.
Liberty may modify, suspend, restrict, or discontinue website or portal functionality when reasonably necessary.

Liberty uses reasonable administrative, technical, and physical safeguards appropriate to the information and systems it maintains.
However, no website, portal, internet transmission, or electronic storage system can be guaranteed to be completely secure.
Users are responsible for maintaining appropriate security on their own computers, networks, email accounts, practice-management systems, and other technology used to access Liberty's services.
Users must promptly notify Liberty if they become aware of unauthorized account access, compromised credentials, or other activity that may affect Liberty's systems or information.
13. Disclaimer Regarding Online Services
To the fullest extent permitted by applicable law, Liberty's website, portal, and general online functionality are provided on an “as is” and “as available” basis.
Liberty does not warrant that the website or portal will operate without interruption, delay, technical error, security incident, or incompatibility with every device or third-party system.
This provision applies to Liberty's website and digital platforms and does not replace any separate warranty applicable to laboratory products or services under Liberty's Terms & Conditions.
14. Limitation of Liability for Website and Portal Use
To the fullest extent permitted by applicable law, Liberty Orthodontic Laboratory and its officers, employees, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising solely from the use of, inability to use, interruption of, or unauthorized access affecting Liberty's website or online services.
This may include damages associated with website interruption, third-party service outages, transmission delays, corrupted files, loss of electronic data, or technical failures outside Liberty's reasonable control.
Nothing in this Legal Policy excludes or limits liability that cannot legally be excluded or limited.
This section applies to Liberty's website and online services. Liability relating to laboratory products, cases, orders, warranties, and other laboratory services is governed separately by Liberty's Terms & Conditions and applicable law.
15. Suspension or Termination of Online Access
Liberty may suspend, restrict, or terminate access to its website, portal, or online services when reasonably necessary because of:
Suspected unauthorized activity.
Security concerns.
Fraudulent or unlawful use.
Violation of this Legal Policy.
Misuse of Liberty's systems.
Legal or regulatory requirements.
Protection of patient, client, or Liberty information.
Suspension of online access does not eliminate obligations arising from laboratory services previously requested or provided.
16. Governing Law and Venue
This Legal Policy and disputes relating specifically to use of Liberty's website, portal, or online services are governed by the laws of the State of Florida, without regard to conflict-of-law principles.
To the extent permitted by applicable law, legal actions arising from or relating to this Legal Policy shall be brought in the appropriate state court located in Broward County, Florida, or, where federal jurisdiction exists, in the appropriate United States District Court serving Broward County, Florida.
17. Changes to This Legal Policy
Liberty may revise this Legal Policy to reflect changes in technology, website functionality, security practices, business operations, or applicable legal requirements.
The Effective Date at the top of this page will be updated when material revisions are made.
Changes apply prospectively from the stated effective date.
Where separate affirmative consent is required by applicable law or another agreement, Liberty will obtain that consent separately.
18. Severability
If any provision of this Legal Policy is determined to be invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed as appropriate.
The remaining provisions will continue in effect.
19. Relationship to Other Agreements
This Legal Policy governs access to and use of Liberty's website, client portal, and online services.
Liberty's Terms & Conditions separately govern laboratory orders, pricing, billing, payment obligations, warranties, remakes, shipping, turnaround, and other terms of laboratory services.
Liberty's Privacy Policy separately describes applicable privacy practices.
Where applicable, protected health information may also be governed by a separate Business Associate Agreement.
If a more specific written agreement applies to a particular subject, the more specific agreement will control with respect to that subject.
